JPS licence invalid, rules Supreme Court - Lead Stories - Jamaica Gleaner - Tuesday | July 31, 2012

JPS licence invalid, rules Supreme Court - Lead Stories - Jamaica Gleaner - Tuesday | July 31, 2012: "The Supreme Court handed down a landmark ruling yesterday that the exclusive licence granted to the Jamaica Public Service Company (JPS) was not valid.

Queen's Counsel (QC) Michael Hylton, who represents the JPS, told The Gleaner yesterday that the light and power company was appealing the ruling. He said JPS did not apply for a stay of the judge's ruling because the court did not strike down the licence which was granted to JPS.

Attorneys-at-law Hugh Wildman and Marvalyn Taylor-Wright, who represented the claimants in the class action suit, have described Justice Bryan Sykes' ruling as a major victory.

They said the ruling meant that the minister, in granting a licence, cannot fetter his discretion precluding other applicants from entering the market, and that was the heart of the claimants' case."
